CONSTITUTION AND OBJECTIVES

 

THE NYFL CONSTITUTION

In 1998, Elders of the Ngarluma and Yindjibarndi people signed an Agreement with the North West Shelf Gas Project JV partners, together with Woodside Energy Ltd as operators, under which payment would be made for land use on the Burrup Peninsular and donations relating to goodwill and mutually beneficial relationships.

The Ngarluma and Yindjibarndi Foundation Ltd – NYFL- was formed and incorporated in 2000, to receive these payments, and ensure the long term management of the funds to effectively support the Foundation’s beneficiaries, particularly the Ngarluma and Yindjibarndi people, and their communities, as defined in its Constitution.

THE FOUNDATION'S VISION

  • To secure an independent future for the Ngarluma and Yindjibarndi people.

  • To realise our social, cultural, economic, health, business and education opportunities.

  • To strengthen our cultural heritage through law, language and art.

THE FOUNDATION'S OBJECTIVES

NYFL was established to promote the interests of the Ngarluma and Yindjibarndi people by:

  • creating and operating initiatives for social, cultural, economic, business and educational developments;
  • creating and operating initiatives for better health and wellbeing;
  • developing, maintaining and providing assistance for education, advancement and training;
  • preserving and enhancing the spoken languages of the Ngarluma and Yindjibarndi people, and developing literacy programs and literature and art consistent with the culture;
  • developing business enterprises, assist in evaluating business opportunities, acquiring business and management skills and helping to develop successful business enterprises; and,
  • developing, encouraging, maintaining and supporting social development programs.

 

PROPOSED CHANGES TO THE CONSTITION 2015

The signing of the original Agreement between Elders of the Ngarluma and Yindjibarndi people and the JV partners of the North West Shelf Gas project in 1998, led to the formation of the Ngarluma Yindjibarndi Foundation, its incorporation and its written Constitution in 2000.

Many things have changed since then – both the Ngarluma and Yindjibarndi people have had their claims recognised and had their PBCs formed. NYFL’s role in the community has also changed, with the advent of NAC and YAC.

To reflect these changes NYFL needs to update its own Constitution – these changes are in the main necessary for NYFL to be legally compliant and in no way change the original intent of the Constitution.
